PB 1-09, Public Hearing, Site Plan Notificiations

PUBLIC HEARING NOTICE

            PLEASE TAKE NOTICE that the PLANNING BOARD of the TOWN OF CORTLANDT will conduct a Public Hearing pursuant to Cortlandt Town Board Resolution No. 83-09 requesting a recommendation to amend the text of the Town of Cortlandt Zoning Ordinance (Chapter 307) to require applicant’s to notify adjacent and across the street property owners of Planning Board Public Hearings on Site Plans.

            Said Public Hearing will be held on Tuesday May 5, 2009 at 8:00 P.M., or as soon thereafter as possible, in the Vincent F. Nyberg Meeting room at Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York, to receive public comments and input, with respect to the proposed amendment as contained in the Town of Cortlandt Zoning Ordinance (Chapter 307) as follows:

Add a new Section 307.72 (c) to the “Public Hearing” section of the Zoning Code:

The applicant with due diligence must provide a copy of the Planning Board’s written public hearing notice for the site development plan application to all abutting property owners, including those across any street adjoining the parcel of land that is the subject of the proposed site development plan.

The Planning Board may also direct that other persons be notified.  Notice must be given more than five (5) and less than twenty-one (21) calendar days prior to the scheduled site development plan public hearing.  Prior to the public hearing the applicant shall submit to the Planning Board a completed affidavit of notification.   Certified mail, return receipt requested, may be utilized to supplement proof of the required notification.

            Anyone interested in addressing comments on the above to the Planning Board may do so by appearing in person at the above time and place or by submitting their written comments to the Cortlandt Planning Office by the close of business on May 4, 2009 at 4:00 p.m.
