PUBLIC HEARING NOTICE

            PLEASE TAKE NOTICE, that the PLANNING BOARD of the TOWN OF CORTLANDT will conduct a Public Hearing pursuant to Chapter 307 (Zoning) of the Town of Cortlandt Code on the application of Shawn M. O’Mara, for the property of Forget About It, L.L.C., for Site Development Plan approval for a change of use from a restaurant to a funeral home with additional parking spaces and an access drive located at 97 Broadway as shown on a 3 page set of drawings entitled “Proposed Site Plan” prepared by Gregory J. McWilliams dated August 26, 2004.

            The subject property of .69 acres is located at 97 Broadway between 4th and 5th Street.  The subject parcel is split zoned with one half of the lot in the CC, Community Commercial zone and the other half in the R-15, Single Family Residential zone.  This property is designated on the Town of Cortlandt Tax Maps as Section 54.05, Block 2, Lot 36.

             Pursuant to 6 NYCRR Part 617 of the State Environmental Quality Review Regulations the subject application is an unlisted action for which a negative declaration is being considered.

            Persons may review said application and drawing at the Planning Office in the Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York, between the hours of 8:30 A.M. and 4:00 P.M., Monday through Friday, except holidays. 

            SAID HEARING will be conducted in the Vincent F. Nyberg General Meeting Room at the Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York on Tuesday evening, January 25, 2005 at 8:00 P.M., or as soon thereafter as possible at which time all interested persons will be heard.
