NOTICE OF COMPLETION OF A FINAL ENVIRONMENTAL IMPACT STATEMENT (FEIS) FOR AN UNLISTED ACTION

NEW YORK STATE ENVIRONMENTAL QULAITY REVIEW (SEQR)

Project No. 9-99              Dated: March 7, 2006

This notice is issued pursuant to Part 617 of the Implementing regulations pertaining to Article 8 (State Environmental Quality Review) of the Environmental Conservation Law.

A Final Environmental Impact Statement (FEIS), entitled “Furnace Dock Subdivision” dated March 7, 2006 prepared by Tim Miller Associates, Inc. has been completed and accepted by the Town of Cortlandt Planning Board as Lead Agency for the proposed action described below.  Written comments on the FEIS are requested and will be accepted by the contact person until April 14, 2006 (unless extended by the Planning Board).  A Public Hearing on the proposed action as described below will be conducted at the Vincent F. Nyberg General Meeting Room, Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York on Tuesday, April 4, 2006 at 8:00 P.M.

Lead Agency: The Lead Agency for the Proposed action is the Town of Cortlandt Planning Board, Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York 10567.  For further information contact Mr. Kenneth Verschoor, Deputy Director, Planning Division, Department of Technical Services, same address as stated above, telephone No. (914) 734-1080.

Description of the Action: Application (PB 9-99) submitted by Furnace Dock Inc. for Preliminary Plat Approval pursuant to Sections 276 and 277 of the New York State Town Law and pursuant to Chapter 265 (Subdivision of Land) of the Town of Cortlandt Code. This application is also for Permits pursuant to Chapter 179 (Freshwater Wetlands), Chapter 259 (Steep Slopes) and Chapter 283 (Trees) of the Town of Cortlandt Code.  The subject application (and the FEIS as submitted)is for a proposed 18 lot conventional subdivision with proposed roads, utilities and other related site improvements on 42.43 acres as shown on a drawing entitled “Grading Plan, 18 Lot Layout” prepared by Ralph G. Mastromonaco, PE, latest revision dated September 28, 2005,or in the alternative a 17 lot loop road alternative as shown on a drawing entitled “17 Lot Loop Road Alternate” prepared by Ralph G. Mastromonaco, PE, latest revision dated March 15, 2006.

Location of Proposed Action: The subject property of 42.43 acres is located on the north side of Furnace Dock Road, 1,500 feet east of Albany Post Road and is designated on the Town of Cortlandt Tax Maps as Section 55.19, Block 1, Lot 1.

Potential Environmental Impacts: Potential large impacts of the proposed action are as follows: (1) The proposed action may significantly impact existing air quality, ground and surface water quality and quantity, traffic and noise levels and result in a substantial increase in potential for erosion, flooding and drainage problems. (2) The proposed action will result in the removal and destruction of large quantities of vegetation and fauna and may substantially interfere with the habitat and movement of resident wildlife species. (3) The proposed action will result in the attracting of a large number of people to a place compared to the number of people who would come to such a place absent the action. (4) The proposed action will result in a demand for additional community services such as school, police, fire, ambulance, sanitation, roadway maintenance and an additional demand on the Town’s water supply system. (5)  The proposed action may significantly impact a site with archaeological/historical importance. (6) The subject project is located within the emergency evacuation area for the Indian Point Nuclear plants. (7) When considered with other development in the area, cumulative effects on the above mentioned items (1) – (6) may also be significant.

Copies of the Statement: Copies of the FEIS are available for review during regular working hours from 9:00 A.M. to 4:00 P.M., Monday through Friday, except holidays, in the Planning Division Office of the Department of Technical Services, Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York. A limited number of copies are available on a loan basis. A fee will be charged to persons requesting their own copy of the FEIS. A copy of the FEIS is also available for review at the Hendrick Hudson Free Library,185 Kings Ferry Road, Montrose, New York.  The FEIS can also be reviewed on the internet at www.townofcortlandt.com.

This Notice of Completion was adopted by the Town of Cortlandt Planning Board on March 7, 2006.
