Lakeview Estates Public Hearing

PUBLIC HEARING NOTICE

     PLEASE TAKE NOTICE, that the PLANNING BOARD of the TOWN OF CORTLANDT will conduct a Public Hearing on the application submitted by Peter Praeger of Mount Airy Associates for Preliminary Plat Approval for a ten (10) lot residential subdivision, or in the alternative a seven (7) lot residential subdivision, pursuant to Sections 276 and 277 of the New York State Town Law and pursuant to Chapter 265 (Subdivision of Land) of the Town of Cortlandt Code and for Permits pursuant to Chapter 179 (Freshwater Wetlands), Chapter 259 (Steep Slopes) and Chapter 283 (Trees) of the Town of Cortlandt Code. This application includes a Final Environmental Impact Statement (FEIS) entitled “Lakeview Estates” prepared by Tim Miller Inc. dated April 4, 2006 pursuant to Part 617 of the implementing regulations pertaining to Article 8 State Environmental Quality Review Act (SEQRA) of the New York State Environmental Conservation Law.

     The subject application and FEIS is for a proposed residential subdivision for 10 lots with a one family dwelling on each lot and other related site improvements on 48.7 acres as shown on a drawing entitled “10 Lot Alternate Lakeview Estates” prepared by Ralph G. Mastromonaco, P.E. latest revision dated January 27, 2006 or in the alternative a 7 lot subdivision as shown on a drawing entitled “7 Lot Alternate, Lakeview Estates” also prepared by Ralph G. Mastromonaco, P.E. latest revision dated January 27, 2006. The FEIS, entitled "Lakeview Estates” latest revision dated April 4, 2006, prepared by Tim Miller Associates, Inc. has been deemed complete by the Town of Cortlandt Planning Board as Lead Agency.  The subject application is classified as a SEQRA Unlisted Action.

     A "Notice of Completion of a Final Environmental Impact Statement (FEIS)" dated April 4, 2006 was adopted by the Town of Cortlandt Planning Board.  Comments on the FEIS are requested and will be accepted in writing by the Planning Board until May 12, 2006 (unless extended by the Planning Board).

Potential large impacts of the subject proposed action are as follows:  (1)  The proposed action may significantly impact existing air quality, ground and surface water quality and quantity, traffic and noise levels and result in a substantial increase in solid waste production and generate a substantial increase in potential for erosion, flooding and drainage problems. (2) The proposed action will result in the removal and destruction of large quantities of vegetation and fauna and may substantially interfere with the habitat and movement of resident wildlife species. (3) The proposed action will result in the attracting of a large number of people to a place compared to the number of people who would come to such place absent the action. (4) The proposed action will result in a demand for additional community services such as school, police, fire, ambulance and sanitation. (5) The subject property is located within the emergency evacuation area for the Indian Point Nuclear Plants. (6) The proposed action is located in the New York City Watershed for the New Croton Reservoir. (7) When considered with other development in the area, cumulative effects on the above mentioned items (1)–(6) may also be significant.

The subject property of 48.7 acres is located on the northerly end of McGuire Lane and is designated on the Town of Cortlandt Tax Maps as Section 56.17, Block 1, Lot 18.

     Persons may review said FEIS, application and drawings at the Planning Office, Town Hall, 1 Heady Street, Cortlandt Manor, New York, between the hours of 8:30 A.M. and 4:00 P.M., Monday through Friday, except holidays. A limited number of copies of the FEIS are available on a loan basis. A fee will be charged to persons requesting their own copy of the FEIS. A copy of the FEIS is also available for review at the Croton Free Library, 171 Cleveland Drive, Croton-on-Hudson, New York.  The FEIS can also be reviewed on the internet at www.townofcortlandt.com.

SAID HEARING will be conducted in the Vincent F. Nyberg General Meeting Room at the Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York, on Tuesday evening, May 2, 2006 at 8:00 P.M. or as soon thereafter as possible at which time all interested persons will be heard.

     The Town Hall is handicapped accessible.
