NOTICE OF COMPLETION OF A DRAFT ENVIRONMENTAL IMPACT STATEMENT (DEIS) AND A NOTICE OF SEQR PUBLIC HEARING FOR AN UNLISTED ACTION

NEW YORK STATE ENVIRONMENTAL QULAITY REVIEW (SEQR)

Project No. 13-05                                                                      Dated: May 1, 2007

This notice is issued pursuant to Part 617 of the Implementing regulations pertaining to Article 8 (State Environmental Quality Review) of the Environmental Conservation Law.

A Draft Environmental Impact Statement (DEIS), entitled “Residences at Mill Court Crossing” dated May 2, 2007 prepared by Tim Miller Associates, Inc. has been completed and accepted by the Town of Cortlandt Planning Board as Lead Agency for the proposed action described below.  Written comments on the DEIS are requested and will be accepted by the contact person until June 15, 2007 (unless extended by the Planning Board).  A Public Hearing on the proposed action as described below will be conducted at the Vincent F. Nyberg General Meeting Room, Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York on Tuesday, June 5, 2007 at 8:00 P.M.

Lead Agency: The Lead Agency for the Proposed action is the Town of Cortlandt Planning Board, Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York 10567.  For further information contact Mr. Kenneth Verschoor, Deputy Director, Planning Division, Department of Technical Services, same address as stated above, telephone No. (914) 734-1080.

Description of the Action: Application (PB 13-05) submitted by Kirquel Development Ltd. for Preliminary Plat Approval pursuant to Sections 276 and 277 of the New York State Town Law and pursuant to Chapter 265 (Subdivision of Land) of the Town of Cortlandt Code. This application is also for Permits pursuant to Chapter 179 (Freshwater Wetlands), Chapter 259 (Steep Slopes) and Chapter 283 (Trees) of the Town of Cortlandt Code.  The subject application (and the DEIS as submitted)is for a proposed 27 lot major subdivision and other related site improvements on 52.78 acres of property as shown on a 10 page set of drawings entitled “Site Development and Subdivision for Residences at Mill Court Crossing” prepared by Cronin Engineering, P.E., P.C. latest revision dated February 13, 2007.

Location of Proposed Action: The subject property of 52.78 acres is located on the west side of Lexington Ave. and at the south end of Mill Court and is designated on the Town of Cortlandt Tax Maps as Section 13.18, Block 2, Lot 2.

Potential Environmental Impacts: Potential large impacts of the proposed action are as follows: (1) The proposed action may significantly impact existing air quality, ground and surface water quality and quantity, including impacts on wetlands, steep slopes, traffic and noise levels and result in a substantial increase in potential for erosion, flooding and drainage problems. (2) The proposed action will result in the removal and destruction of large quantities of vegetation and fauna and may substantially interfere with the habitat and movement of resident wildlife species. (3) The proposed action will result in the attracting of a large number of people to a place compared to the number of people who would come to such a place absent the action. (4) The proposed action will result in a demand for additional community services such as school, police, fire, ambulance, sanitation, roadway maintenance and an additional demand on the Town’s water supply and sanitary sewer systems.  (5) The subject project is located within the emergency evacuation area for the Indian Point Nuclear plants. (6) When considered with other development in the area, cumulative effects on the above mentioned items (1) – (5) may also be significant.

Copies of the Statement: Copies of the DEIS are available for review during regular working hours from 9:00 A.M. to 4:00 P.M., Monday through Friday, except holidays, in the Planning Division Office of the Department of Technical Services, Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York. A limited number of copies are available on a loan basis. A fee will be charged to persons requesting their own copy of the DEIS. A copy of the DEIS is also available for review at the John C. Hart Memorial Library, 1130 Main Street,  Shrub Oak, NY  10588 and is also available on the Town’s Website at www.townofcortlandt.com

This Notice of Completion and Notice of SEQR Public Hearing was adopted by the Town of Cortlandt Planning Board on May 1, 2007.
